Spain Residency: How to Get Permanent Residence After 5 Years?
Have you been living in Spain for several years and want to settle here permanently? After five years of legal residence in the country, it is possible to apply for Spanish permanent residence, a status that allows you to stay in Spain indefinitely and enjoy extended rights. In this article, we explain the difference between temporary and permanent residence, the conditions to become a permanent resident, the detailed application procedure, and tips to maximize your chances of success. Finally, we will look at the prospects after 5 years, especially regarding a possible naturalization.

Introduction to Permanent Residence
Permanent residence in Spain is a key step for foreigners wishing to settle in the country for the long term. This status allows you to live, work, and enjoy Spanish life without time constraints, while benefiting from great stability, although the applicable regime and conditions differ for EU citizens and non-EU nationals. EU citizens can apply for permanent residence after five years, and certain family members of a EU citizen or of a Spanish citizen may also obtain it, provided that the residence requirements and the family relationship are duly met. Whether you came to Spain for work, study, or to join your family, permanent residence is the key to feeling completely at home in this warm and dynamic country.
Types of Residence in Spain
Spain offers several types of residence. Temporary residence (residencia temporal), is often the first step, valid for 1 or 2 years and renewable. After five years of regular residence, permanent residence (residencia permanente) offers the possibility to live and work in Spain without a time limit. For the second main case, a non-EU foreigner must present a NIE and prove five years of continuous residence in Spain to obtain this resident status. For EU citizens, the permanent route also relies on five years of residence, but the EU permanent residence card lasts ten years and is renewable. There are also specific schemes like the Golden Visa, for foreign investors. Time spent under a student visa generally are not counted toward the five years required, and EU citizens do not need to prove a job at this stage.
Temporary vs. Permanent Residence
Temporary residence corresponds to a stay of more than 90 days but less than 5 years. The most important part of the difference is that permanent residence is obtained only after five years of legal and continuous residence in Spain. It allows you to live and work in Spain without a time limit and gives non-EU nationals the right to hold a permanent residence card valid for five years, without constant renewals, a real administrative relief. It is the last step before being able to apply for Spanish nationality, but it does not grant the same rights as nationality, since permanent residents do not have the right to vote in national elections.

Conditions for Permanent Residence
1. Length of Stay
You must prove at least five years of uninterrupted legal residence in Spain. Absences are tolerated as long as they do not exceed six consecutive months during the five-year period, with a maximum of ten months in total. This is the case for keeping resident status, and permanent residence can still be maintained with an absence of up to one year outside the EU, while a longer absence may lead to its loss.
2. Financial Self-Sufficiency
You must be able to support yourself without relying on state aid. For certain statuses, especially for a non-EU applicant, the applicant will need to show sufficient means through regular income, savings and a valid health insurance policy. These resources are one of the elements reviewed in immigration applications related to long-term residence.
3. Clean Criminal Record
A clean criminal record in Spain and in your country of origin is essential, and the applicant must present a clean record to show that they do not pose a threat to public order; depending on the file, a criminal record certificate may also be required by the competent authority.
4. Integration
A basic knowledge of Spanish and familiarity with the local culture are major assets, although not formally assessed by an exam at this stage.
Integration Tip
Participating in community life, local events, or simply building relationships with your neighbors are excellent ways to demonstrate your commitment to Spanish society.

After 5 Years, and Then?
Permanent residence and Spanish nationality are not the same, and holders of permanent residence retain their original citizenship and are not allowed to vote in Spanish national elections. Access to Spanish nationality is generally possible after 10 years of total legal residence, with exceptions for some nationalities, including the Philippines.
In any case, the permanent resident card greatly facilitates life in Spain, offering you stability and security. For non-EU nationals, the card itself must still be renewed every five years even if the right of stay remains the same.
